These Terms and Conditions (“Terms”) govern your use of the Bahari House website and the booking of accommodation and related services offered through it. By accessing this website, submitting a booking request, or making a payment, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not use this website or submit a booking request.
These Terms should be read alongside our Privacy Policy and our Refunds & Cancellations Policy, both of which form part of the agreement between you and Bahari House.
In these Terms, the following words have the meanings set out below:
3.1 Permitted Use
This website is provided for the purpose of exploring accommodation at Bahari House and submitting booking requests. You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the website.
3.2 Accuracy of Information
We make every reasonable effort to ensure that the information on this website including: room descriptions, photographs, pricing, and availability — is accurate and up to date. However, we do not warrant that all content is error-free at all times. Prices and availability are subject to change without notice until a booking is confirmed.

4.1 Booking Requests
Submitting a booking request through this website does not constitute a confirmed booking. A booking is only confirmed once the host has approved your request and you have completed the required deposit payment via the secure payment link provided.
During the vetting window between request submission and host decision, no payment is taken and no contractual obligation to provide accommodation exists on the part of Bahari House.
4.2 Guest Vetting
Bahari House operates a host-approved booking model. All guests are required to provide accurate personal information, including country of residence and any additional qualifying information requested on the booking form. This information is used solely for the purpose of guest vetting prior to acceptance.
The host reserves the right to decline any booking request at their absolute discretion, without being required to provide a reason. No declined request entitles the prospective guest to any form of compensation.
4.3 Accuracy of Guest Information
You warrant that all information provided during the booking process is accurate, complete, and truthful. Providing false or misleading information including: the number of guests, intended use of the property, or personal identity — may result in immediate cancellation of your booking without refund.
4.4 Booking Confirmation
Your booking is confirmed when you receive an official booking confirmation email from Bahari House following successful deposit payment. Please retain this confirmation for your records. If you do not receive a confirmation within 24 hours of payment, please contact us immediately.
5.1 Deposit
A non-refundable deposit of 50% of the total booking value is required to confirm your booking. This deposit is payable via the secure payment link sent to you upon host approval. The deposit is processed through PayFast, a South African payment processor. Bahari House does not store your payment card details.
5.2 Balance Payment
The remaining 50% balance is due prior to check-in, as communicated in your booking confirmation. Failure to settle the balance by the due date may result in cancellation of your booking, subject to the terms of our Refunds & Cancellations Policy.
5.3 Currency
All transactions are processed in South African Rand (ZAR). While our website may display indicative pricing in other currencies (USD, EUR, GBP) for the convenience of international guests, the ZAR amount shown at checkout is the binding amount. Bahari House accepts no liability for any exchange rate differences between the indicative foreign currency display and the final ZAR charge.
5.4 Transaction Fees
PayFast transaction fees are charged at the time of payment and are non-recoverable. These fees are set by PayFast and may vary. Where a refund is due, any non-recoverable transaction fees will be deducted from the refund amount.
Check-in and check-out times will be communicated in your booking confirmation. Early check-in and late check-out are available as add-on services and are subject to availability. Requests for early check-in or late check-out that have not been booked and paid for in advance cannot be guaranteed.
On arrival, you may be required to present valid identification matching the name on the booking confirmation. Bahari House reserves the right to refuse entry if the person arriving does not match the confirmed guest details.
7.1 General Conduct
All guests are expected to treat the property, furnishings, and surroundings with care and respect. Bahari House is a private property and a home, and we ask that guests conduct themselves accordingly at all times.
7.2 Guest Capacity
The number of guests staying at the property must not exceed the number declared at the time of booking. Unauthorised additional guests are not permitted and may result in immediate termination of your stay without refund.
7.3 Events & Gatherings
Hosting events, parties, or large gatherings on the property is not permitted without prior written approval from the host. Any request to host a gathering must be submitted before the booking is confirmed and is subject to the host’s sole discretion.
7.4 Noise & Neighbours
Guests are expected to be considerate of neighbours and the surrounding community at all times, particularly during late evening and early morning hours. Excessive noise that disturbs neighbours may result in termination of the stay.
7.5 Smoking
Smoking inside the property is strictly prohibited. Any damage or additional cleaning costs resulting from smoking indoors will be charged to the guest.
7.6 Pets
Pets are not permitted on the property unless explicitly agreed to in writing by the host prior to booking confirmation.
7.7 Damages & Loss
Guests are responsible for any damage to the property, furnishings, fixtures, or fittings caused during their stay. Any damage beyond normal wear and tear will be assessed after check-out and the cost of repair or replacement will be invoiced to the guest. Bahari House reserves the right to pursue recovery of such costs.

Add-on services such as airport transfers, early check-in, and other offerings may be booked through the website either as part of a booking or as standalone purchases after confirmation. All add-on services are subject to availability.
Where an add-on involves a third-party service provider (such as a transport operator), Bahari House acts as a facilitator only and accepts no liability for the performance of that third party. Any concerns regarding a third-party service should be directed to the relevant provider.
To the fullest extent permitted by applicable law:
You agree to indemnify and hold harmless Bahari House, its owner, and any agents from and against any claims, damages, losses, or expenses (including legal costs) arising from your breach of these Terms, your use of the property, or your conduct during your stay.
All content on this website including: text, photographs, graphics, logos, and design — is the property of Bahari House or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this website without prior written permission.
This website may reference or link to third-party platforms such as Airbnb, LekkaSlaap, PayFast, and Google. These links are provided for convenience only. Bahari House does not control and accepts no responsibility for the content, privacy practices, or terms of any third-party platform.
Bookings made through third-party platforms such as Airbnb or LekkaSlaap are governed by the terms of those platforms, not these Terms.
Your use of this website and submission of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using this website, you confirm that you have read and agree to our Privacy Policy.
Cancellations and refunds are governed by our Refunds & Cancellations Policy, which is incorporated into these Terms by reference. By confirming a booking, you agree to the terms of that policy.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms or your use of this website shall be subject to the jurisdiction of the South African courts.
We reserve the right to update or amend these Terms at any time. Changes will be published on this page with an updated date. Your continued use of the website or submission of a booking request after changes are published constitutes your acceptance of the revised Terms.
The version of these Terms in effect at the time your deposit is received governs your booking.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.
These Terms, together with the Privacy Policy and Refunds & Cancellations Policy, constitute the entire agreement between you and Bahari House in respect of your use of this website and any booking made through it. They supersede all prior representations, discussions, or agreements.
